Altitude Pole & Fitness (“Altitude Pole”, "us", "we", or "our") operates www.altitudepole.co.nz (hereinafter referred to as the "Service").

Altitude Pole operates in New Zealand, and is therefore governed by New Zealand Law. Our primary privacy legislation is the Privacy Act 2020 (“Privacy Act”).

We may use and store information about your location if you give us permission to do so ("Location Data"). We use this data to provide features of our Service, to improve and customise our Service. You can enable or disable location services when you use our Service at any time by way of your device settings.

Tracking & Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Legal Basis for Collecting Data under the Privacy Act
As a New Zealand based company, the collection of personal information by us is governed by the Privacy Act. Personal information can only be collected where it is for a lawful purpose connected with a business function or activity, and the information is necessary for that purpose.​

As such, we will only ask for and collect information where it is both lawful and necessary for our functions as a business. We will never request information that we do not believe fulfils these requirements.

Retention of Data
Altitude Pole will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. Altitude Pole will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Transfer of Data
If you are located outside of New Zealand and choose to provide information to us, your data will be transferred here and managed in accordance with New Zealand laws.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Altitude Pole will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Information will take place to an organisation or a country outside of New Zealand unless there are adequate controls in place, including the security of your data and other personal information.

Disclosure of Data

Business Transaction
If Altitude Pole is involved in a merger, acquisition or asset sale, your Personal Information may be transferred. We will provide notice before your Personal Information is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement
Under certain circumstances, Altitude Pole may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Altitude Pole may disclose your Personal Information in the good faith belief that such action is necessary to:

  • To protect and defend the rights or property of Altitude Pole

Security of Data
The security of your data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Our Policy on "Do Not Track" Signals
We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

Your Data Protection Rights under the Privacy Act

Note that where your information is held by one of our franchises, we may need to direct you to them to assist with your query or request.

  • The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Information directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.

  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.

  • The right to object. You have the right to object to our processing of your Personal Information.

  • The right of restriction. You have the right to request that we restrict the processing of your personal information.

  • The right to withdraw consent. You also have the right to withdraw your consent at any time where Altitude Pole relied on your consent to process your personal information.

Please note that we may ask you to verify your identity before responding to such requests.

You have the right to complain to the Office of the Privacy Commissioner about our collection and use of your Personal Information.

Service Providers

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

The Google Suite
Altitude Pole uses a variety of services within the Google Suite. These include Google Drive, Gmail, Data Studio, Google Sheets, and Google Docs. At times, Personal Information may be stored on these platforms.

TypeForm and JotForm is an online form building service. We use this tool frequently for obtaining feedback and collecting other information.

ActiveCampaign
ActiveCampaign is an automated email and sales marketing tool. We use this service primarily for email campaigns, and therefore some Personal Information is stored there, such as names and email addresses.

Analytics
We may use third-party Service Providers to monitor and analyse the use of our Service.

Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

Behavioural Remarketing
Altitude Pole uses remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Service.

Google Ads (AdWords) remarketing service is provided by Google Inc.
