Altitude Pole & Fitness ("Altitude Pole", "us", "we", or "our") operates the websites www.altitudepole.co.nz, ignite.altitudepole.co.nz, instruct.altitudepole.co.nz, and start.altitudepole.co.nz, as well as any other subdomains under the altitudepole.co.nz domain (collectively referred to as the "Service").

Altitude Pole operates in New Zealand, and is therefore governed by New Zealand law. Our primary privacy legislation is the Privacy Act 2020, as amended by the Privacy Amendment Act 2025 (the "Privacy Act").

This page informs you of our policies regarding the collection, use and disclosure of personal information when you use our Service, and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

Personal Information means data about a living individual who can be identified from that data (or from that and other information either in our possession or likely to come into our possession).

We use third-party software and AI-assisted tools to help us understand and improve our Service. This includes:

Analysing class bookings, attendance and membership usage patterns to improve scheduling, retention and member experience
Using AI tools to help us analyse aggregated business data (such as booking trends, sales performance and marketing results)

What this means for you:

We do not use AI to make decisions that have a significant legal or similarly significant effect on you (for example, membership cancellation, refusal of service, or debt recovery decisions) without human review.
Any AI tools we use that process your Personal Information are bound by the same confidentiality and data-use obligations as our other Service Providers (see "Service Providers" below).
AI tools may be used to help draft marketing content, but any offers, pricing or contractual terms presented to you are reviewed and authorised by our team.

Use of Data

Altitude Pole uses the collected data for various purposes:

To provide and maintain our Service

To allow you to participate in interactive features of our Service when you choose to do so

To gather analysis or valuable information so that we can improve our Service, including through AI-assisted analytics
To monitor the usage of our Service

Legal Basis for Collecting Data under the Privacy Act

As a New Zealand-based company, our collection of personal information is governed by the Privacy Act. Personal information can only be collected where it is for a lawful purpose connected with a business function or activity, and the information is necessary for that purpose.

We will only ask for and collect information where it is both lawful and necessary for our functions as a business. We will never request information that we do not believe fulfils these requirements.

Information collected indirectly: Where we collect personal information about you from a source other than you directly (for example, from a lead form, referral, or third-party platform), we will take reasonable steps to let you know what information we hold, where it came from, and how it will be used, in line with Information Privacy Principle 3A.

Retention of Data

Altitude Pole will retain your Personal Information only for as long as necessary for the purposes set out in this Privacy Policy, including to comply with legal obligations, resolve disputes, and enforce our agreements and policies. Usage Data is generally retained for a shorter period, except where it is used to strengthen security, improve functionality, or we are legally required to retain it for longer.

Transfer of Data

If you are located outside New Zealand and choose to provide information to us, your data will be transferred here and managed in accordance with New Zealand law.

Your consent to this Privacy Policy, followed by your submission of information, represents your agreement to that transfer.

We will take reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy, and no transfer of your Personal Information will take place to an organisation or country outside New Zealand unless adequate controls are in place.

Disclosure of Data

Business Transaction: If Altitude Pole is involved in a merger, acquisition or asset sale, your Personal Information may be transferred. We will provide notice before your Personal Information is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement: We may be required to disclose your Personal Information if required by law or in response to valid requests by public authorities.

Legal Requirements: We may disclose your Personal Information in the good faith belief that such action is necessary to:

Comply with a legal obligation
Protect and defend the rights or property of Altitude Pole
Prevent or investigate possible wrongdoing in connection with the Service
Protect the personal safety of users of the Service or the public
Protect against legal liability

Security of Data

The security of your data is important to us, but no method of transmission over the internet or electronic storage is 100% secure. While we use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Our Policy on "Do Not Track" Signals

We do not currently respond to Do Not Track ("DNT") browser signals.

Your Data Protection Rights under the Privacy Act

Altitude Pole aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Information.

If you wish to know what Personal Information we hold about you, or want it removed from our systems, contact us at hq@altitudepole.co.nz. Where your information is held by one of our franchisees, we may need to direct you to them to assist with your request.

Under the Privacy Act, you have the right to:

Access, update or delete the information we hold about you
Request rectification if information is inaccurate or incomplete
Object to our processing of your Personal Information
Request restriction of processing of your Personal Information
Withdraw consent at any time where we relied on your consent to process your data
Complain to the Office of the Privacy Commissioner about our collection and use of your Personal Information

We may ask you to verify your identity before responding to such requests.

Service Providers

We may employ third-party companies and individuals ("Service Providers") to facilitate our Service, provide the Service on our behalf, or help us analyse how our Service is used, including AI-assisted analytics tools. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Children's Privacy

Some of our studios offer youth classes (including youth aerials), and we accept members aged 16 and 17 with parental or guardian consent. Where a class participant or member is under 18:

Enrolment, consent and any required waivers must be provided by a parent or legal guardian, not the child themselves.
We collect only the personal information necessary for class administration and safety (such as the child's name, date of birth, and emergency contact details), and this is provided to us by the parent or guardian, not gathered directly from the child via our website.
We do not knowingly collect Personal Information directly from a child under 16 without verified parental or guardian consent.
We do not market directly to children, and marketing communications relating to youth classes are directed to the parent or guardian's contact details.
A parent or guardian may contact us at any time to access, correct or request deletion of their child's Personal Information.

If you become aware that a child has provided us with Personal Information without the required parental or guardian consent, please contact us so we can address it.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any significant, non-superficial changes by posting the updated policy on this page and updating the "effective date" above. Where required, we will also notify you by email or a prominent notice on our Service prior to the change taking effect.
